Billing
Rental Research Services, Inc. generates a bill for all reports you order at the end of each month. This means that all billing statements will be available online for you to view at the beginning of every month (usually on the 1st). Simply log on with your username and your password, then click on the "Billing" section to view, print and pay your most current bill, as well as being able to view or print previous bills. You will also receive a notification via your e-mail address to inform you that your most current billing statement is available for you. Please note that if you have not had account activity during a particular month, you will not receive a billing statement.
SUBSCRIBER SERVICE AGREEMENT:
This is a fairly standardized agreement that says that you will use the information provided for a lawful purpose, pay for the services you use and let us know if you ever decide to stop using our service, amongst other things. It is understood that:
“Our”, “ours”, “us” and “we” in the following text refers to Rental Research Services, Inc.
“You” and “your” in the following text refers to the company and/or individual(s) whose information is supplied in the above fields who are making this application for online tenant screening.
“Agreement” refers to this Subscriber Service Agreement.
FCRA COMPLIANCE: You agree to comply fully and faithfully with the provisions of the Fair Credit Reporting Act (FCRA), 15 U.S.C. || 1681 et seq., as those provisions may be from time to time amended.
TENANT RIGHTS AND PRIVILEGES: You agree to accord all applicants for residential tenancies all the rights and privileges conveyed to applicants for consumer credit by the FCRA, 15 U.S.C. || 1681 et seq., including but not limited to the rights set forth in Section 615 of the FCRA, 15 U.S.C. || 1681 M.
APPLICANT NOTIFICATION: You agree not to contact us in connection with any application for residential tenancy without first notifying the applicant in writing that his or her application will be evaluated and a consumer credit report obtained by or developed by us. This may best be accomplished by using our Application for Occupancy form (available online).
DELINQUENT ACCOUNTS: We reserve the right to suspend service to you during any period in which your account remains delinquent for more than 45 days. If delinquency is not corrected within a reasonable time as determined by us, we reserve the right to terminate this Subscriber Service Agreement by written notice to you, free from any and all liability. Continuance of service and payment during any period of delinquency shall not constitute a waiver of our right of termination.
TIMELINESS OF PAYMENT: You are required to pay your bill in full each month. A delinquency charge of 1.5% (one and one-half percent) per month will be added to the outstanding balance of any account on the first day of the month following billing. Minimum re-billing fee is $3.00.
ENFORCEMENT: If it becomes necessary for us to take steps, whether by suit or otherwise, to enforce collection, or to defend, preserve, or enforce our rights under this agreement, you promise to pay all costs incurred by us, including reasonable attorney fees.
LIMITATION OF LIABILITY: We shall not be held liable for any delays in, failure of or suspension of service caused by mechanical or power failure, strikes, labor difficulties, fire, inability to operate or obtain service from our vendors or their equipment, unusual delay in transportation, acts of God, or other causes beyond our control.
RATE CHANGES: We reserve the right to change our rates upon 30 days written notice to you. You shall have the right to terminate this agreement in the event of a change in the rates.
ASSIGNMENT: This agreement may be assigned by you only with our written consent. You will not permit any persons other than your own officers, agents or employees to use the subscriber identification number assigned by us.
AUTOMATIC RENEWAL TERMS: This agreement shall be automatically renewed based on the term of agreement chosen (or annually if not a set term contract), and upon the same terms, unless either party gives written notice of its intention to change said term or terminate the agreement.
TERMINATION OF AGREEMENT: Thirty (30) day agreements may be terminate by written notice to us. If you choose a term of agreement that allows for a discount on any of our products and/or services, then you will use our tenant screening service exclusively for the term of agreement chosen. If you terminate this agreement prior to the agreed upon term, or your usage drops below 1/2 of your historical monthly average (adjusted for time of year), you will be charged an amount equal to the amount of any discount given on all products and services ordered during your contract term, plus $250.00. If special pricing was arranged in order to facilitate this agreement, no other special discounts or offers may apply.
GOVERNING LAW: This agreement shall be governed by, and construed in accordance with, the laws of the State of Minnesota.
“AS IS” WITHOUT WARRANTY: We make no warranty, expressed or implied, other than as expressly set forth here in, and it is agreed that no implied in-law warranty shall arise from this agreement or it’s performance by us. We in no way guarantee the accuracy, reliability or correctness of the information, nor do we assume responsibility for any loss due to your reliance on the information reported. Information is gathered from many sources including but not limited to local, state and federal government and that information is not guaranteed as accurate.
CONFIDENTIALITY: All information whether written or printed, on paper or electronically, or verbally furnished by us shall be held in strict confidence and you further acknowledge the end user responsibilities for access security of reports supplied by us (see FTC Data Safeguards Law).
END USER: You acknowledge that you are the end user of reports supplied by us and agree not to resell reports supplied by us.
FULL AGREEMENT: This agreement, which includes the information you submitted during the application process, constitutes the full and complete agreement of the parties. This agreement may not be altered, amended or otherwise varied except by written mutual agreement of both parties. By selecting the option "YES", I understand that if my application is accepted, I will be bound by the terms, conditions, and limitations of this agreement. |
